Terms of Service

By creating an account or otherwise using Elevence AI you agree to these Terms. They apply equally to the web app at elevence.ai and to the iOS and Android apps.

1. The service

Elevence AI ("the service", "we") is operated by NextGen AI Dev Private Limited. The service routes your prompts to one of 60+ AI models from third-party providers and returns the result.

2. Account & eligibility

You must be at least 13 years old (16 in the EEA / UK) to create an account.
•
You are responsible for keeping your sign-in credentials secure.
•
One person per account; sharing accounts is not permitted.
•
Organisation owners are responsible for the activity of members they invite.

3. Acceptable use

You will not use Elevence AI to generate, distribute, or assist content that is illegal, deceptive, or violates the rights of others. The full rules are in our Acceptable Use Policy at /aup, which is incorporated into these Terms by reference.

4. Your content

You retain all rights to the prompts you submit and the outputs you generate.
•
You grant us a worldwide, royalty-free licence to host, store, and process your content solely so that we can deliver and operate the service.
•
You represent that you have the necessary rights to anything you upload.
•
Outputs may be similar or identical to outputs given to other users; AI models can produce comparable results across requests.

5. Credits, billing & refunds

The service is metered in credits, deducted per request based on the underlying model's price plus a service margin.
•
Credit purchases are non-refundable except where required by law.
•
We may modify pricing with at least 30 days' email notice.
•

6. Service availability

We aim for 99.9% monthly uptime but do not warrant uninterrupted service. Planned maintenance windows are announced in advance on our status page. We are not liable for downstream failures caused by AI providers we route to.

7. Suspension & termination

You may close your account from Settings at any time.
•
We may suspend or terminate accounts that breach these Terms, the AUP, or applicable law.
•
On termination, your data is deleted on our 90-day backup cycle (see Privacy Policy).

8. Disclaimers

The service and any AI-generated output are provided "as is" without warranties of any kind. AI models can be inaccurate, biased, or inconsistent. Do not rely on outputs for medical, legal, financial, or other professional advice without independent verification.

9. Limitation of liability

To the maximum extent permitted by law, our aggregate liability arising from your use of the service is limited to the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) USD 100. We are not liable for indirect, incidental, special, or consequential damages.

10. Governing law & disputes

These Terms are governed by the laws of India. Any dispute arising under these Terms will be subject to the exclusive jurisdiction of the courts located at our registered office. Nothing in this clause limits any statutory consumer rights you may have where you live.

11. Changes to these Terms

We will post a new "Last updated" date when these Terms change. Continued use of the service after a change constitutes acceptance.
